JBC Testimony spurs Colorado Medicaid Department to cease implementation of 3 proposed cuts!!!

Thanks to everyone who participated in the Joint Budget Committee (JBC) Open Mic marathon on Monday February 2. Many submitted written comment or signed up to speak in person or remotely about anything related to the budget. This made a huge impact!

I posted the screen shots I got from a Feb 3 email that case managers received from HCPF (healthcare policy and financing, our state medicaid agency) the day after the JBC hearing on social media and that post is nearing 10,000 views! I know people are hungry for updated information and wow that showed!

BADASS SUMMARY:

The heat is turned up after YOU ALL participated and voiced your concerns!

The actions of HCPF have been more like a steam roller, moving forward with out following proper process and procedure with rule making and budget approval authority.

This is an indicator that the tide is turning but EVERY DAY something happens so please see action steps below to stay involved!

The department withdrew the Movement therapy proposed rate reduction entirely from their budget request in January.

New This Week

Update on Long-Term Services and Supports (LTSS) Sustainability Actions

As state authorities change, our implementation plans for LTSS budget reductions must also change.

These actions are necessary to address both the immediate budget shortfall resulting from the passage of H.R.1 and Colorado’s ongoing structural budget deficit. The combined fiscal impact required the Office of Community Living (OCL) to begin implementation under the short-term authority of the Governor’s Executive Order, while simultaneously pursuing long-term authority through legislation and rulemaking.

The Executive Order is scheduled to expire at the end of February. Because LTSS planning typically occurs 60–90 days in advance, OCL began providing information and training to case management agencies in January to support timely and consistent conversations with members and families about the proposed reductions.

The Joint Budget Committee (JBC) has since chosen to table two actions—the 56-hour weekly caregiver cap and the IRSS rate alignment. As a result, OCL is pausing related operational guidance until the JBC takes final action.

This sequence is not typical. We recognize that shifting guidance creates real rework and uncertainty, and that this impacts members, families, advocates, provider organizations, and case management agencies. Our goal remains to provide timely communication and transparency as decisions evolve, while acknowledging the burden these changes place on those responsible for implementing them.

We appreciate the patience, professionalism, and continued partnership of our case management agencies, providers, advocates, and community partners as we navigate these complex fiscal and policy challenges together.

Initiatives Paused at This Time

The following initiatives are paused pending further action from the JBC.

Individual Residential Services and Supports (IRSS) – Rate Alignment

Implementation of IRSS rate alignment is temporarily on hold pending further direction.

56-Hour Caregiving Cap

Implementation of the 56-hour caregiving cap is temporarily on hold pending further direction.

HCPF will share additional information for both Medicaid Sustainability Actions once future implementation options and timelines are determined in coordination with the JBC.

Community Connector Age Limit

HCPF has received additional guidance from The Centers for Medicare and Medicaid Services (CMS) related to the Community Connector age limit. CMS recommended that HCPF more clearly outline when the service may be required based on assessed need, provide more information about parental responsibility, and confirm the appropriate application of the service for children. HCPF is incorporating this guidance into the waiver amendment and rules and has asked case managers to temporarily pause until further clarification and guidance can be provided. This guidance does not substantially alter the Department’s original policy and stakeholders should anticipate a resumption of this action shortly.

At this time:

  • There is no change to the overall rollout plan, but HCPF is asking case managers to pause implementation until further clarification is provided.
  • Members who have already spoken with their Case Manager and received a Notice of Action do not need to reach out again. The Case Manager will contact the member when and if follow-up is required.

Looking Ahead

HCPF understands that changes and pauses can create uncertainty for members, families, and other stakeholders. These decisions are being made to ensure compliance with federal guidance, alignment with legislative direction, and the long-term sustainability of Medicaid and LTSS in Colorado.

Medical Services Board Friday 13th Rule making body ACTION OPPORTUNITY

There is an open comment period at the end of the agenda as well for things NOT pertaining to agenda items.

On Friday 13th, are two rule change proposals up that impact our HCBS/LTSS community.

One is an emergency rule adoption (which last month a different one was shot down regarding residential IRSS services for DD waiver and the MSB board members were NOT happy with HCPF saying they were inappropriately using emergency rule process)

This emergency rule is regarding Community Connector Services. Members who access Community Connector will be impacted by this rule as the existing annual service cap will be reduced.Legally Responsible Persons providing over 5 hours of Homemaker per member per week will also experience a reduction in working hours.With Governor Polis’s ExecutiveOrder D 2025 014, dated October 31, 2025, HCPF must implement budget sustainabilitymeasures in the Spring of 2026 to ensure a balanced budget. These changes must be reflected in members’ Person-Centered Support Plans (PCSP) effective April 1, 2026

This means the board will get an overview and hear from stakeholders and the rule will appear two more times to get final vote.

The proposed rule revises the Home and Community-Based Services (HCBS) case management rules to include updated supporting documentation and signature requirements. All members receiving HCBS and all HCBS case management agencies (CMAs) will be affected. The Department considered maintaining the rules in their current, separate locations. without updating citations or signature requirements. This approach was rejected because it would perpetuate outdated language, create confusion, and make HCBS case management rules less accessible. Consolidating and updating the rules, as proposed, was determined to be the most effective method to achieve clarity, consistency, and ease of compliance.

    • Written testimony received after 5:00 p.m. on the Thursday before the meeting will not be shared with Board members in advance of the meeting. Board members will receive the testimony after the meeting.
  • In Person or Remote Testimony
    • Testimony can be provided in person at the meeting.
    • Testimony can be given over the phone and over the computer at the time of the meeting. If you wish to provide testimony over the telephone please sign up for testimony using the Google form. Individuals providing remote testimony will be given time after individuals in the room.
    • Testimony can be emailed to chris.sykes@state.co.us in advance of the meeting and will be distributed to the Medical Services Board members.
    • After public testimony for a rule or public comment begins, we cannot accept any additional sign-ups. We will provide multiple opportunities to sign up before the deadline.

Maureen urges top legislative leaders on 2/5 South Denver Town Hall to protect medicaid disability services

JBC Chair Rep Sirota, Senate President Senator Coleman and Senate Majority Leader Sen Rodriguez all answered with support and asked for help to find ways to save costs! See the you tube short videos to hear their answers!

I ran a few ideas by them:

1. Implement a two or three year waiting period for HCBS waiver applications for those who move her to Colorado for our services .

2. Look at an across the board cut for executive branch department budgets, with more for HCPF since they have grown in full time equivalent employees (FTEs) by some counts over 80% since 2020.

3. A drastic way to reduce HCBS waiver enrollments would be implementing more waitlists for everyone for more waivers (currently we only have a waitlist for DD waiver). This would help cost containment but is a hard thing to do for sure. I stated I worried watering down medicaid with caps, limits and restrictions would make them less helpful overall.

Showing up in your community for town halls is a great opportunity to connect with leaders.
